Introduction

This Privacy Policy outlines Snow Effects (" we ", " our " or " the Company ") practices with respect to information collected from users who access our website at www.snoweffects.com (" Site "), or otherwise share personal information with us (collectively: " Users "). 

Grounds for data collection 

Processing of your personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter " Personal Information ") is necessary for the performance of our contractual obligations towards you and providing you with our services, to protect our legitimate interests and for compliance with legal and financial regulatory obligations to which we are subject.

When you use the Site, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy.

We encourage our Users to carefully read the Privacy Policy and use it to make informed decisions. 

What information we collect?

We collect two types of data and information from Users. 

The first type of information is un-identified and non-identifiable information pertaining to a User(s), which may be made available or gathered via your use of the Site (“ Non-personal Information ”). We are not aware of the identity of a User from which the Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time, etc.) in order to enhance the functionality of our Site. We may also collect information on your activity on the Site (e.g. pages viewed, online browsing, clicks, actions, etc.).

How do we receive information about you?

We receive your Personal Information from various sources:

Retention

We will retain your personal information for as long as necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations. 

We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

We and our trusted partners use cookies and other technologies in our related services, including when you visit our Site or access our services.

Third party collection of information

Our policy only addresses the use and disclosure of information we collect from you. How do we safeguard your information?

Transfer of data outside the EEA 

Please note that some data recipients may be located outside the EEA. In such cases we will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection.

We may use your Personal Information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials, concerning our services, which we believe may interest you.  

Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists. 

Please note that even if you have unsubscribed from receiving marketing emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices.

Corporate transaction

We may share information in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy.

Minors

We understand the importance of protecting children’s privacy, especially in an online environment. The Site is not designed for or directed at children. Under no circumstances shall we allow use of our services by minors without prior consent or authorization by a parent or legal guardian. We do not knowingly collect Personal Information from minors. Updates or amendments to this Privacy Policy

We reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the "Last modified" section. Your continued use of the Platform, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.

Snow Effects Terms and Conditions:

These terms and conditions apply to the viewing, purchasing and sale of products through www.snoweffects.com (the “site”) or our catalog. By viewing this site, placing an order or completing a purchase, you agree to be bound by and accept these terms and conditions.


Limitation of Liability:

Snow Effects will not be liable for any indirect, special, incidental, or consequential damages, whether based on contract, tort, or any other legal theory, including without limitation loss of profits, loss of business, or other economic damages. Snow Effects is not responsible for delays in delivery which result from any circumstances beyond its control. Snow Effects’s aggregate liability shall not exceed the purchase price paid for any products purchased through this site, or, if no such products were purchased, ten dollars ($10.00).
Pricing and Specifications: All information regarding pricing, products and services is subject to change. Snow Effects reserves the right to make adjustments to pricing and products for reasons including, but not limited to, changing market conditions, discontinuation, unavailability, manufacturer price changes and errors in advertisements. Prices listed are net and do not include shipping charges, handling fees, taxes and/or duties or special crating requirements for export shipment. Those customers who claim exemption from taxes or duties are responsible for providing Snow Effects with the necessary documentation at the time of purchase or taxes will be added to their order for required states. Snow Effects strives to maintain prices at the lowest level. Occasionally, prices change without notice due to circumstances beyond our control.


Returns:

Product is considered seasonal and generally not returnable unless defective. However, if you have unused or unopened product in saleable condition, you can call (719) 440-468-7669 and request authorization to return. We will only accept returns in unopened, original packaging. There is a 15% restocking fee. Customers will be responsible for shipping charges on cancelled orders and on returned product. If a product is damaged during delivery to you via a freight carrier, note the damage on the carrier’s delivery receipt, take a picture, and request an inspection report on the damaged shipment from the carrier to be forwarded to you within 10 business days. Forward the inspection report, picture(s) and original packing list to Snow Effects and we will file a claim on your behalf and immediately replace the damaged item(s) provided it is in stock. If a product is damaged during delivery to you via Fedex Ground or Express, you must note the extent of the damage on the back of the packing list. Once complete, forward the form to Snow Effects and hold the damaged materials for disposition instructions.


Warranties:

Since we cannot control how product is used or treated, Snow Effects warranty is limited to product arriving in good condition. Any warranty with respect to products not produced by Snow Effects must come from the actual manufacturer. Snow Effects will pass through to customers any applicable warranties of the manufacturer to the extent permissible. Notwithstanding anything to the contrary, Snow Effects liability is limited to the replacement value of the products purchased from this site. Snow Effects and its affiliates hereby expressly disclaim all warranties either expressed or implied, related to products, including, without limitation, any warranty of merchantability or fitness for a particular purpose, or warranty of noninfringement. This disclaimer does not affect the terms of the manufacturer’s warranty, if any.


Payment Terms:

For those customers with established Snow Effects credit, payment terms are net 30 days from the date of invoice. In addition, Snow Effects accepts all major credit cards at the time of order. COD is only available for those orders picked up at a Snow Effects warehouse.

Ownership of Materials, Trademarks and Copyright: The information contained in this site including all images, designs, photographs, text and other materials (the “contents”) are copyrights, trademarks, or other intellectual property owned or licensed by Snow Effects or its affiliates, or are the property of their respective owners. The contents of this site may not be copied, republished, downloaded, transmitted, mirrored or reproduced without the prior written permission of Snow Effects or the applicable copyright owner.


Applicable Law:

This site is controlled by us from our offices within the State of Colorado, United States of America. By accessing this site, you agree that the laws of the State of Colorado, without regard to conflicts of laws principles, will apply to all matters relating to the use of this site and the purchase of products available through this site. Any litigation will be brought exclusively in Chaffee County, Colorado and customer consents to the jurisdiction of the Federal and State Courts located therein, submits to the jurisdiction thereof and waives the right to change venue.

Entire Agreement: These terms and conditions constitute the entire agreement and understanding between you, the customer, and Snow Effects concerning the subject matter hereof and supersedes all prior agreements and understandings of the parties with respect thereto, including any oral statements made by Snow Effects representatives or any alternate terms supplied by you to Snow Effects unless otherwise agreed to by Snow Effects in writing. To the extent that anything in or associated with site is in conflict or inconsistent with these terms and conditions, these terms and conditions shall take precedence
